Called to Order:  7:30 PM under the M.G.L. chapter 131, s.40 and the Hanson By-Law 1-13 s.5.  by Arthur Gelsi, Chairman

Public Hearings

7:30 PM  Three (3) Notice of Intents (NOI)  for Elm St., Lot 5,  Map 27, Lot 1-5, DEP #175-401, Elm St., Lot 7, Map 19, Lot 1-7, DEP #175-400 & Elm St., Lot 9, Map 19, Lot 1-9, DEP #175-403 for single family dwellings on each and associated sitework with Deborah Keller of McKenzie Engineering Group, 196 Central St., Saugus, MA

Ms. Keller presented plans depicting the above-mentioned lots.  The houses and septic systems are out of the 100-foot buffer zone.    Mr. Gelsi would like silt fences installed with pea-stone as well as the haybales along the driveways.  Ms. Cassady will specify in the Order of Conditions.  Mr. Grattan would like to inspect before the excavation of the foundation.  Mr. Gelsi asked the Board if they had any questions.  There were none.

Motion to accept the NOI’s for Lots 5, 7  & 9 pending conditions (hay bales & silt fences):  Arthur Gelsi

8:00 PM  Continued NOI for west side of Union St., Map 31, Lots 7a & 6 for construction of a single family house and septic system with Don Ellis, Elko Construction, Inc., P.O. Box 485, Hanson and Al Vautrinot  of Vautrinot Land Surveying, Inside #175-369

Mr. Vautrinot presented plans depicting a 24 x 38 foot house that is within the 50-foot no disturb zone.  Mr. Gelsi indicated that a smaller house was called for

Mr. Vautrinot said that the width of the house can be reduced, and the garage can be moved to the front of the house so that the driveway can be relocated.  Mr. Gelsi said the Board would look at the plan again after changes have been made.

9:00 PM  RDA for 117 Beechwood Rd., Map 115, Lot 17 for an addition to an existing single family house with April Young, owner.

Ms. Young presented plans for a 2-car garage with a family room, 2 bedrooms and the enlargement of the kitchen by 8 feet.  Ms. Cassady had made a site visit and observed the plot plan.  Mr. Gelsi asked if there were any questions.  Ms. Gardner asked for haybales and a silt fence.  Mr. Gelsi indicated that he would like the haybales double staked and cut off level.

        Motion to approve the RDA with conditions:  Mrs. McKeen

9:15 PM  Informal Meeting with Ken Sweezey of 51 Mattakeesett Street regarding the reconstruction of his driveway without a filing.  

Mr. Gelsi told Mr. Sweezey that the Board had received complaints about the driveway.    Mr. Sweezey said a paving company did the work and that there were no conditions when they built the house which is 900-feet in from the street.  He also said the beginning of the driveway is located in Pembroke.  Mr. Grattan said that there were cat-o-nine tails on one side of the driveway at the entrance indicating wetlands.   Ms. Cassady pulled a file on the property from the previous owner in 1994.  There was a standard Order of Conditions.  There was also a Superseding Order of Conditions asking for replication and erosion controls for the driveway.  Ms. Cassady would like to monitor the replication to see if it was successful.  Mr. Gelsi asked if we had permission to go on the property to inspect.  Mr. Sweezey will call the office to notify the Board of his availability.  The Board thanked him for coming in and appreciated him answering their questions.

9:30 PM  NOI for 764 E. Washington St., Map 114, Lot 0021-01 for an addition to an existing single family house owned by Andrew and Marion Ryan represented by Brad Holmes of Environmental Consulting & Restoration, 17 Langford Rd., Plymouth, MA

Mr. Holmes presented plans showing an addition located on an already existing paved driveway.
The proposal calls for removing part of the pavement and to do some native plantings in a gravel area that will be raked out and disposed of off site.  

Mrs. McKeen left the meeting at 9:40 PM

Ms. Cassady noted that the construction was not an expansion and that the work being done outside was a replication and an enhancement, not an alteration.  Mr. Gelsi iterated that he would prefer that no bobcats be used and would like the gravel to be hand raked.

Signing of Special Orders of Conditions

1.      Negative Determination of Applicability (DOA) for Catherine Kuchinski, Old Road, Map 039, Lot 0032A, repaving of driveway
2.      Order of Conditions (OCC) for New England Architectural Builders and Remodelers, 482 Elm St., Map 27, Lot 1-6, construction of a single family dwelling.  DEP #175-398

Acceptance of Minutes

July 8, 2003 – postponed

Discussions  (8:00 PM)

1.       Enforcement Orders to Cease and Desist were ratified by the Board for 269 Spring Street, 480 E. Washington St. and 70 Surrey Lane.  The owner for 269 Spring St. and 480 E. Washington St. was charged a $50 fee for a second inspection of both properties.   Mr. Gelsi wanted to make sure that the DEP was notified of 269 Spring St..  Tricia talked to owner of 70 Surrey Lane.  They are doing landscaping.
2.      Ms. Cassady will call the owner of 153 Wagon Trail to ask him to move a temporary garage that he erected until he builds a new garage, to the other side of the house out of the buffer zone.
3.      Ms. Cassady will send a letter to the owner of 251 Grey Lane to discuss excavating his property.

4.      Owner of Three Brothers Landscaping is asking for an extension of an Order of Conditions for completion of work.


Motion to give Extension to an Orders of Conditions for three years to complete work:  Mr. Grattan

Vote:  5-0-0  

5.      Ms. Cassady will call Mark Ridder to schedule a site walk with him tentatively, Tuesday, July 15, at 10 AM with member Phil Lindquist and herself.

6.      Mr. John J Goldrosen, an attorney from Kopelman & Paige, P.C. 31 St. James Ave., Boston, MA introduced himself at 9:05 PM to discuss Open Meeting Law and Hearing Requirement Procedures.  He made a presentation and passed out literature for each of the Board Members and the Agent to read.  The Board thanked him for his input.
